For the seventh straight year, medical malpractice insurance rates have fallen, according to the medical news publisher Medscape.  See the article here.  Overall, since 2008 insurance rates for doctors has fallen 13%.  The apparent reason for the rate drops is the decreasing number of medical malpractice claims and the generally flat overall payments made for claims.

Unfortunately, this does not mean that malpractice is decreasing.  Given the increases in our population and the stories of the people who call our office, that would be unlikely.  What it most likely reflects is the public’s reluctance to find against doctors and hospitals in malpractice suits.  This has caused lawyers who represent those injured by medical negligence to be even more cautious about the cases they take.  The number of malpractice cases filed in Superior Court in Arizona has been falling for years.  This means that many people who have been hurt by medical mistakes will not be able to make a claim for the compensation they deserve.  Lastly, it shows that “tort reform” is a political solution in search of a problem.  Before you let them take away your rights, make sure there is a good reason for it.  Right now, there isn’t one.
